Article L1321-7 of the French Public Health Code

I.-Without prejudice to the provisions of article L. 214-1 of the Environment Code, the use of water for human consumption, with the exception of natural mineral water, is subject to authorisation from the State representative in the département, for :

1° Production ;

2° Distribution via a public or private network, with the exception of distribution for the use of a family mentioned in III and distribution via private networks supplied by a public distribution network;

3° Packaging.

II – The following are subject to declaration to the representative of the State in the department:

1° The extension or modification of collective distribution installations which do not significantly alter the conditions of the authorisation provided for in I ;

2° Distribution by private networks supplied by a public distribution network that may present a risk to public health;

III -The use of water for human consumption for the use of a family is subject to declaration to the mayor, under the conditions set out in article L. 2224-9 of the General Local Authorities Code.

IV -Any device for using rainwater for domestic domestic purposes must be declared to the mayor of the municipality concerned, in accordance with the conditions laid down in article L. 2224-9 of the General Local Authorities Code;

Article L1321-7

I.-Sans préjudice des dispositions de l’article L. 214-1 du code de l’environnement, est soumise à autorisation du représentant de l’Etat dans le département l’utilisation de l’eau en vue de la consommation humaine, à l’exception de l’eau minérale naturelle, pour :

1° La production ;

2° La distribution par un réseau public ou privé, à l’exception de la distribution à l’usage d’une famille mentionnée au III et de la distribution par des réseaux particuliers alimentés par un réseau de distribution public ;

3° Le conditionnement.

II.-Sont soumises à déclaration auprès du représentant de l’Etat dans le département :

1° L’extension ou la modification d’installations collectives de distribution qui ne modifient pas de façon notable les conditions de l’autorisation prévue au I ;

2° La distribution par des réseaux particuliers alimentés par un réseau de distribution public qui peuvent présenter un risque pour la santé publique ;

III.-Est soumise à déclaration auprès du maire l’utilisation d’eau en vue de la consommation humaine à l’usage d’une famille, dans les conditions prévues à l’article L. 2224-9 du code général des collectivités territoriales.

IV.-Tout dispositif d’utilisation de l’eau de pluie pour les usages domestiques intérieurs fait l’objet d’une déclaration auprès du maire de la commune concernée, dans les conditions prévues à l’article L. 2224-9 du code général des collectivités territoriales ;
