Article L1322-10 of the French Public Health Code

Occupation of a plot of land included within the protection perimeter for the purposes of carrying out the work provided for in article L. 1322-8 may only take place by virtue of an order issued by the representative of the State in the département, which sets the duration of the order.

When the occupation of land included within the perimeter or the application of articles L. 1322-3 to L. 1322-7 deprives the owner of the enjoyment of the income for more than one year or when, after the work, the land is no longer fit for the purpose for which it was used, the owner of this land may require the owner of the source to acquire the occupied or denatured land.

In this case, the compensation is set in accordance with the provisions in force for expropriation in the public interest.

In no case may expropriation be instigated by the owner of the spring.

Article L1322-10

L’occupation d’un terrain compris dans le périmètre de protection pour l’exécution des travaux prévus par l’article L. 1322-8 ne peut avoir lieu qu’en vertu d’un arrêté du représentant de l’Etat dans le département qui en fixe la durée.

Lorsque l’occupation d’un terrain compris dans le périmètre ou l’application des articles L. 1322-3 à L. 1322-7 prive le propriétaire de la jouissance du revenu au-delà du temps d’une année ou lorsque après les travaux le terrain n’est plus propre à l’usage auquel il était employé, le propriétaire de ce terrain peut exiger du propriétaire de la source l’acquisition du terrain occupé ou dénaturé.

Dans ce cas, l’indemnité est fixée conformément aux dispositions en vigueur en matière d’expropriation pour cause d’utilité publique.

Dans aucun cas, l’expropriation ne peut être provoquée par le propriétaire de la source.
