Article L1322-8 of the French Public Health Code

Within the protection perimeter, the owner of a spring declared to be in the public interest has the right to carry out on another person’s land, with the exception of dwellings and adjoining yards, all the catchment and development work necessary for the conservation, operation and distribution of this spring, where such work has been authorised.

The owner of the land is heard in the appraisal.

Dans l’intérieur du périmètre de protection, le propriétaire d’une source déclarée d’intérêt public a le droit de faire dans le terrain d’autrui, à l’exception des maisons d’habitation et des cours attenantes, tous les travaux de captage et d’aménagement nécessaires pour la conservation, la conduite et la distribution de cette source, lorsque ces travaux ont été autorisés.

Le propriétaire du terrain est entendu dans l’instruction.
