Article L1324-3 of the French Public Health Code

I.-The following is punishable by one year’s imprisonment and a fine of 15,000 euros:

1° Offering or selling to the public water for human consumption, including ice, without ensuring that the water or ice is fit for consumption or use;

2° Using water unfit for consumption for the preparation and preservation of any foodstuffs and goods intended for human consumption, with the exception of the cases provided for in application of article L. 1322-14;

3° Carrying out the activities listed in I of article L. 1321-7 and I of article L. 1322-1 without the authorisations they provide for;

4° Not complying with the provisions of the acts declaring a public utility or the acts declaring a public utility mentioned in article L. 1321-2;

5° Not complying with the provisions relating to the prohibition and regulation of activities, works, deposits and installations within the protection perimeters mentioned in articles L. 1322-3 to L. 1322-7;

6° Not complying with the provisions of I of article L. 1321-4 or, for mineral waters, article L. 1322-2;

7° Refusing to take any of the measures provided for in II of article L. 1321-4 to eliminate a serious risk to public health;

8° Bringing water intended for human consumption through open canals in violation of the provisions of article L. 1321-8.

Article L1324-3

I.-Est puni d’un an d’emprisonnement et de 15 000 euros d’amende le fait :

1° D’offrir ou de vendre au public de l’eau en vue de l’alimentation humaine, y compris la glace alimentaire, sans s’être assuré que cette eau ou cette glace est propre à la consommation ou à l’usage qui en est fait ;

2° D’utiliser de l’eau impropre à la consommation pour la préparation et la conservation de toutes denrées et marchandises destinées à l’alimentation humaine, à l’exception des cas prévus en application de l’article L. 1322-14 ;

3° D’exercer les activités énumérées au I de l’article L. 1321-7 et au I de l’article L. 1322-1 sans les autorisations qu’ils prévoient ;

4° De ne pas se conformer aux dispositions des actes portant déclaration d’utilité publique ou des actes déclaratifs d’utilité publique mentionnés à l’article L. 1321-2 ;

5° De ne pas se conformer aux dispositions relatives à l’interdiction et à la réglementation des activités, travaux, dépôts et installations, dans les périmètres de protection mentionnés aux articles L. 1322-3 à L. 1322-7 ;

6° De ne pas se conformer aux dispositions prévues au I de l’article L. 1321-4 ou, concernant les eaux minérales, à l’article L. 1322-2 ;

7° De refuser de prendre toute mesure prévue au II de l’article L. 1321-4 pour faire cesser un risque grave pour la santé publique ;

8° D’amener par canaux à ciel ouvert de l’eau destinée à l’alimentation humaine en violation des dispositions de l’article L. 1321-8.
