Article L1331-11 of the French Public Health Code

Sanitation department employees have access to private property:

1° For the application of articles L. 1331-4 and L. 1331-6 ;

2° To carry out the inspection of non-collective sanitation installations as provided for in III ofarticle L. 2224-8 of the General Code of Local Authorities;

3° To carry out maintenance, rehabilitation and construction work on non-collective sanitation facilities in application of the same III;

4° To monitor the discharge of wastewater other than domestic wastewater and the use of water for purposes similar to domestic use.

The agents of the urban rainwater management service have access to private property to carry out the checks provided for in the second paragraph of article L. 2226-1 of the same code.

In the event of an obstacle to the performance of the tasks referred to in 1°, 2° and 3° of this article, the occupier is required to pay the sum defined inarticle L. 1331-8, under the conditions laid down by this article.

Les agents du service d’assainissement ont accès aux propriétés privées :

1° Pour l’application des articles L. 1331-4 et L. 1331-6 ;

2° Pour procéder à la mission de contrôle des installations d’assainissement non collectif prévue au III de l’article L. 2224-8 du code général des collectivités territoriales ;

3° Pour procéder à l’entretien et aux travaux de réhabilitation et de réalisation des installations d’assainissement non collectif en application du même III ;

4° Pour assurer le contrôle des déversements d’eaux usées autres que domestiques et des utilisations de l’eau assimilables à un usage domestique.

Les agents du service de gestion des eaux pluviales urbaines ont accès aux propriétés privées pour procéder au contrôle prévu au deuxième alinéa de l’article L. 2226-1 du même code.

En cas d’obstacle mis à l’accomplissement des missions visées aux 1°, 2° et 3° du présent article, l’occupant est astreint au paiement de la somme définie à l’article L. 1331-8, dans les conditions prévues par cet article.
