Article L1331-22 of the French Public Health Code

Any premises, facility, immovable property or group of premises, facilities or immovable property, whether vacant or not, that constitutes, either by itself or due to the conditions in which it is occupied, operated or used, a danger or risk to the health or physical safety of people is unfit for habitation.

The presence of degraded coatings containing lead in concentrations exceeding the thresholds and conditions mentioned in article L. 1334-2 renders a premises unfit for habitation.

The decrees issued in application of article L. 1311-1 and, where applicable, the orders issued in application of article L. 1311-2 specify the definition of unfit for habitation situations.

Tout local, installation, bien immeuble ou groupe de locaux, d’installations ou de biens immeubles, vacant ou non, qui constitue, soit par lui-même, soit par les conditions dans lesquelles il est occupé, exploité ou utilisé, un danger ou risque pour la santé ou la sécurité physique des personnes est insalubre.

La présence de revêtements dégradés contenant du plomb à des concentrations supérieures aux seuils et aux conditions mentionnés à l’article L. 1334-2 rend un local insalubre.

Les décrets pris en application de l’article L. 1311-1 et, le cas échéant, les arrêtés pris en application de l’article L. 1311-2 précisent la définition des situations d’insalubrité.
