Article L1331-8 of the French Public Health Code

As long as the owner has not complied with the obligations set out in articles L. 1331-1 to L. 1331-7-1, he is required to pay a sum at least equivalent to the fee he would have paid to the public sewerage service if his building had been connected to the network or equipped with a statutory independent sewerage system, and which may be increased by a proportion set by the municipal council or the council of the Lyon metropolitan area, up to a limit of 400%.

This sum is not recovered if the connection obligations set out in the same articles L. 1331-1 to L. 1331-7-1 are met within a period of twelve months from the date on which notification of the penalty is sent.

The conditions under which the sums mentioned in the first paragraph are established, recovered and allocated are determined by decree in the Conseil d’Etat.

Article L1331-8

Tant que le propriétaire ne s’est pas conformé aux obligations prévues aux articles L. 1331-1 à L. 1331-7-1, il est astreint au paiement d’une somme au moins équivalente à la redevance qu’il aurait payée au service public d’assainissement si son immeuble avait été raccordé au réseau ou équipé d’une installation d’assainissement autonome réglementaire, et qui peut être majorée dans une proportion fixée par le conseil municipal ou le conseil de la métropole de Lyon dans la limite de 400 %.

Cette somme n’est pas recouvrée si les obligations de raccordement prévues aux mêmes articles L. 1331-1 à L. 1331-7-1 sont satisfaites dans un délai de douze mois à compter de la date d’envoi de la notification de la pénalité.

Les conditions dans lesquelles sont instituées, recouvrées et affectées les sommes mentionnées au premier alinéa sont déterminées par décret en Conseil d’Etat.
