The provisions applicable to swimming pools and bathing facilities are monitored by the agents mentioned in articles L. 1421-1 and L. 1435-7 and by the agents of the Ministry of Sport.

The assessment of the quality and classification of bathing water is carried out by the Director General of the Regional Health Agency on the basis of analyses carried out in application of this chapter, in particular in the context of health monitoring. The Director General of the Agency sends the results of the classification to the representative of the State in the department, who notifies them to the person responsible for the water and to the mayor.

Without prejudice to the provisions of articles L. 1421-3-1 and L. 1435-7-3, swimming pools under the authority or supervision of the Minister of Defence are inspected by inspection and control officers under the authority of the armed forces health service. Ministry of Sport officials may also carry out these inspections under the conditions set out in article L. 1421-3-1.

Le contrôle des dispositions applicables aux piscines et aux baignades aménagées est assuré par les agents mentionnés aux articles L. 1421-1 et L. 1435-7 ainsi que par les agents du ministère chargé des sports.

L’évaluation de la qualité et le classement de l’eau de baignade sont effectués par le directeur général de l’agence régionale de santé à partir des analyses réalisées en application du présent chapitre, notamment au titre du contrôle sanitaire. Le directeur général de l’agence transmet les résultats du classement au représentant de l’Etat dans le département, qui les notifie à la personne responsable de l’eau et au maire.

Sans préjudice des dispositions des articles L. 1421-3-1 et L. 1435-7-3, les piscines relevant de l’autorité ou de la tutelle du ministre de la défense sont contrôlées par les agents d’inspection et de contrôle relevant de l’autorité du service de santé des armées. Les agents du ministère des sports peuvent également effectuer ces contrôles dans les conditions prévues à l’article L. 1421-3-1.
