Article L1332-7 of the French Public Health Code

Detailed rules for the application of this chapter relating to bathing water shall be determined by decree, and in particular :

1° The health regulations which bathing waters must comply with, depending in particular on the nature, use and frequency of use of the facilities, and whether they are existing or to be created;

2° The terms and conditions relating to the definition of the bathing season, the preparation, revision and updating of bathing water profiles, the monitoring programme, public information and participation, harmonised standards, methods and analysis practices relating to bathing water quality, the classification of bathing waters and health inspections carried out by the Regional Health Agency;

3° The nature, purpose and means of transmitting the information provided by the person responsible for the bathing water to the Director General of the Regional Health Agency and the means by which the latter transmits it to the representative of the State in the Department.

Article L1332-7

Sont déterminées par décret les modalités d’application du présent chapitre relatives aux eaux de baignade, et notamment :

1° Les règles sanitaires auxquelles doivent satisfaire les eaux de baignade en fonction notamment de la nature, de l’usage et de la fréquentation des installations, et suivant qu’il s’agit d’installations existantes ou à créer ;

2° Les modalités relatives à la définition de la saison balnéaire, à l’élaboration, la révision et l’actualisation des profils des eaux de baignade, au programme de surveillance, à l’information et à la participation du public, aux normes, méthodes et pratiques d’analyse harmonisées relatives à la qualité des eaux de baignade, au classement des eaux de baignade ainsi qu’au contrôle sanitaire exercé par l’agence régionale de santé ;

3° La nature, l’objet et les modalités de transmission des renseignements que fournit la personne responsable de l’eau de baignade au directeur général de l’agence régionale de santé et les modalités selon lesquelles celui-ci les transmet au représentant de l’Etat dans le département.
