I.-The person responsible for a nuclear activity shall set up a system for recording and analysing events that may lead to accidental or unintentional exposure of persons to ionising radiation. This system is proportionate to the nature and extent of the risks involved.
These events, when they are likely to have a significant impact on the interests mentioned in Article L. 1333-7, are declared to the representative of the State in the department and to the Nuclear Safety Authority.
Events likely to lead to a radiological emergency shall be declared without delay by the person responsible for a nuclear activity to the State representative in the department and to the Nuclear Safety Authority.
Health professionals involved in the therapeutic management or monitoring of patients exposed to ionising radiation for medical purposes, who are aware of an event likely to be detrimental to the health of individuals as a result of this exposure, shall report it as soon as possible to the Nuclear Safety Authority and to the Director General of the Regional Health Agency, without prejudice to the application of Article L. 5212-2. The Director General of the Regional Health Agency shall inform the representative of the State with territorial jurisdiction in accordance with the conditions laid down in Article L. 1435-1.
II – The authorisation of an activity likely to cause a radiological emergency may be subject to the establishment of an internal emergency plan setting out the organisation and resources intended to deal with different types of situation.
