Article L1334-11 of the French Public Health Code

On a proposal from the Director General of the Regional Health Agency or, by application of the third paragraph of article L. 1422-1, the Director of the municipal health and hygiene service of the municipality concerned, the State representative in the département may prescribe any protective measures, including stopping work, if work entails a risk of exposure to lead for the occupants of a building or the surrounding population.

The cost of any precautionary measures taken will be borne by the owner, co-owners’ association or operator of the accommodation.

Sur proposition du directeur général de l’agence régionale de santé ou, par application du troisième alinéa de l’article L. 1422-1, du directeur du service communal d’hygiène et de santé de la commune concernée, le représentant de l’Etat dans le département peut prescrire toutes mesures conservatoires, y compris l’arrêt du chantier, si des travaux entraînent un risque d’exposition au plomb pour les occupants d’un immeuble ou la population environnante.

Le coût des mesures conservatoires prises est mis à la charge du propriétaire, du syndicat de copropriétaires, ou de l’exploitant du local d’hébergement.
