Article L1334-16 of the French Public Health Code

In an emergency, the representative of the State may:

1° Have the owner or, failing that, the operator of the building concerned carry out, at the owner’s or operator’s expense, the surveys and diagnoses referred to in article L. 1334-12-1 or the expert appraisal referred to in 2° of article L. 1334-15;

2° Set a deadline for carrying out the protective measures required to stop exposure to asbestos. If these measures have not been carried out by the end of the deadline, it shall have them carried out automatically at the expense of the owner or operator.

The public debt is recovered in the same way as for direct taxation.

En cas d’urgence, le représentant de l’Etat peut :

1° Faire réaliser, aux frais du propriétaire ou, à défaut, de l’exploitant de l’immeuble concerné, les repérages et diagnostics mentionnés à l’article L. 1334-12-1 ou l’expertise mentionnée au 2° de l’article L. 1334-15 ;

2° Fixer un délai pour la réalisation des mesures conservatoires nécessaires pour faire cesser l’exposition à l’amiante. Si ces mesures n’ont pas été exécutées à l’expiration du délai, il fait procéder d’office à leur exécution aux frais du propriétaire ou de l’exploitant.

La créance publique est recouvrée comme en matière de contributions directes.
