Any work carried out on the communal areas of a block of flats used in whole or in part for residential purposes, built before 1 January 1949, which is likely to cause a substantial deterioration in the coverings, as defined by order of the ministers responsible for health and construction, must be preceded by a lead exposure risk report as referred to in article L. 1334-5.
If such a report establishes the absence of coverings containing lead or the presence of coverings containing lead in concentrations below the thresholds defined by order of the ministers responsible for health and construction, there is no need to have a new report drawn up when new work is carried out on the same areas.
In any event, a lead exposure risk report must be drawn up for the communal areas of an apartment block used in whole or in part for residential purposes, built before 1 January 1949, within four years of the date on which Act no. 2004-806 of 9 August 2004 on public health policy comes into force.
