If the report, drawn up under the conditions mentioned in articles L. 1334-6 to L. 1334-8-1, reveals the presence of degraded coatings containing lead in concentrations above the thresholds defined by the decree mentioned in the first paragraph of I of article L. 1334-2, the owner or operator of the accommodation must inform the occupants and any persons required to carry out work in the building or part of the building concerned. The owner or operator must carry out appropriate work to eliminate the risk of exposure to lead, while ensuring the safety of the occupants. If the property is rented out, the landlord is responsible for carrying out this work. Failure by the landlord to carry out this work before the property is rented out constitutes a breach of specific safety and precautionary obligations for which the landlord may be held criminally liable.
