Article L1334-9 of the French Public Health Code

If the report, drawn up under the conditions mentioned in articles L. 1334-6 to L. 1334-8-1, reveals the presence of degraded coatings containing lead in concentrations above the thresholds defined by the decree mentioned in the first paragraph of I of article L. 1334-2, the owner or operator of the accommodation must inform the occupants and any persons required to carry out work in the building or part of the building concerned. The owner or operator must carry out appropriate work to eliminate the risk of exposure to lead, while ensuring the safety of the occupants. If the property is rented out, the landlord is responsible for carrying out this work. Failure by the landlord to carry out this work before the property is rented out constitutes a breach of specific safety and precautionary obligations for which the landlord may be held criminally liable.

Si le constat, établi dans les conditions mentionnées aux articles L. 1334-6 à L. 1334-8-1, met en évidence la présence de revêtements dégradés contenant du plomb à des concentrations supérieures aux seuils définis par l’arrêté mentionné au premier alinéa du I de l’article L. 1334-2, le propriétaire ou l’exploitant du local d’hébergement doit en informer les occupants et les personnes amenées à faire des travaux dans l’immeuble ou la partie d’immeuble concerné. Il procède aux travaux appropriés pour supprimer le risque d’exposition au plomb, tout en garantissant la sécurité des occupants. En cas de location, lesdits travaux incombent au propriétaire bailleur. La non-réalisation desdits travaux par le propriétaire bailleur, avant la mise en location du logement, constitue un manquement aux obligations particulières de sécurité et de prudence susceptible d’engager sa responsabilité pénale.
