The right to commission can only be extinguished if it is established that the contract between the third party and the principal will not be performed and if the non-performance is not due to circumstances attributable to the principal.

Commissions that the commercial agent has already received are reimbursed if the related right is extinguished.

Le droit à la commission ne peut s’éteindre que s’il est établi que le contrat entre le tiers et le mandant ne sera pas exécuté et si l’inexécution n’est pas due à des circonstances imputables au mandant.

Les commissions que l’agent commercial a déjà perçues sont remboursées si le droit y afférent est éteint.
