Article L1342-3 of the French Public Health Code

The procedures for applying the provisions of this chapter, in particular the persons who have access to the information declared pursuant to Article L. 1342-1, the conditions under which the confidentiality with regard to third parties of information covered by industrial secrecy is preserved and the conditions under which the marketing, advertising and use of dangerous substances and mixtures may, for public health reasons, be subject to prohibition, restriction or special requirements proportionate to the nature of the danger or risk they pose to human health.

Article L1342-3

Sont déterminées par décret en Conseil d’Etat les modalités d’application des dispositions du présent chapitre, notamment les personnes qui ont accès aux informations déclarées en application de l’article L. 1342-1, les conditions dans lesquelles est préservée la confidentialité à l’égard des tiers des informations couvertes par le secret industriel ainsi que les conditions dans lesquelles la mise sur le marché, la publicité et l’emploi des substances et des mélanges dangereux peuvent, pour des raisons de santé publique, faire l’objet de mesures d’interdiction, de restriction ou de prescriptions particulières proportionnées à la nature du danger ou du risque qu’ils comportent pour la santé humaine.
