Article L1343-2 of the French Public Health Code

Failure by a manufacturer, importer or downstream user of any substance or mixture to comply with the obligations laid down in … is punishable by three months’ imprisonment and a fine of €20,000:

1° Article L. 1341-1 relating to the information needed to prescribe preventive and curative measures ;

2° In article L. 1342-1 relating, in the case of a hazardous mixture, to the information required to be provided on this mixture, or to its participation in the conservation and use of the information and its contribution to covering the resulting expenses;

3° A l’article L. 1340-5 en matière d’intoxication humaine.

Article L1343-2

Est puni de trois mois d’emprisonnement et de 20 000 € d’amende le fait pour un fabricant, un importateur ou un utilisateur en aval de toute substance ou de tout mélange de ne pas s’acquitter des obligations prévues :

1° A l’article L. 1341-1 relatives aux informations nécessaires à la prescription de mesures préventives et curatives ;

2° A l’article L. 1342-1 relatives, en matière de mélange dangereux, aux informations nécessaires devant être fournies sur ce mélange, ou à sa participation à la conservation et à l’exploitation des informations et à sa contribution à la couverture des dépenses en résultant ;

3° A l’article L. 1340-5 en matière d’intoxication humaine.
