The organisations mentioned in 1° of Article L. 135-1 may only use the works mentioned in that same article as part of their cultural, educational and research missions and on condition that they do not pursue any profit-making aims and that, where applicable and for a period of no more than seven years, they only receive revenue covering the costs directly arising from the digitisation and making available to the public of the orphan works they use. They shall mention the names of the identified rightholders, respect their moral rights and communicate the information provided for in 2° of article L. 135-3 or to l’article L. 135-4. This use is made according to the following terms and conditions:
1° Making an orphan work available to the public in such a way that anyone can access it on their own initiative;
2° Reproducing an orphan work for the purposes of digitisation, making it available, indexing, cataloguing, preservation or restoration.
