Article L135-5 of the French Intellectual Property Code

When the diligent, proven and serious searches mentioned in Article L. 135-3 have made it possible to identify and locate the holder or holders of the rights in a work, the work ceases to be orphan.

When a work has more than one rightholder and it has not been possible to identify and locate all the rightholders, the use of the work provided for in article L. 135-2 is subject to the authorisation of the rightholder or rightholders identified and located.

Article L135-5

Lorsque les recherches diligentes, avérées et sérieuses mentionnées à l’article L. 135-3 ont permis d’identifier et de retrouver le ou les titulaires des droits sur une œuvre, celle-ci cesse d’être orpheline.

Lorsqu’une œuvre a plus d’un titulaire de droits et que tous ses titulaires n’ont pu être identifiés et retrouvés, l’utilisation de l’œuvre prévue à l’article L. 135-2 est subordonnée à l’autorisation du ou des titulaires identifiés et retrouvés.
