Article L1411-9 of the French General Code of Local Authorities

The territorial authority shall forward to the representative of the State in the department or, where applicable, to his delegate in the arrondissement, or to the representative of the State in the region, the public service delegations of the territorial authorities, pursuant to articles L. 2131-2, L. 3131-2 and L. 4141-2 of this code. It attaches all the documents listed in a decree issued by the Conseil d’Etat within fifteen days of signing the contract.

It shall certify, by a note affixed to the agreement notified to the delegation holder, that it has indeed been transmitted, specifying the date of such transmission.

It shall inform, within a period of fifteen days, the representative of the State in the department or his delegate in the arrondissement of the date of notification of this agreement.

Article L1411-9

L’autorité territoriale transmet au représentant de l’Etat dans le département ou, le cas échéant, à son délégué dans l’arrondissement, ou au représentant de l’Etat dans la région, les délégations de service public des collectivités territoriales, en application des articles L. 2131-2, L. 3131-2 et L. 4141-2 du présent code. Elle joint l’ensemble des pièces dont la liste est fixée par décret en Conseil d’Etat dans un délai de quinze jours à compter de la signature du contrat.

Elle certifie, par une mention apposée sur la convention notifiée au titulaire de la délégation, que celle-ci a bien été transmise, en précisant la date de cette transmission.

Elle informe, dans un délai de quinze jours, le représentant de l’Etat dans le département ou son délégué dans l’arrondissement de la date de notification de cette convention.
