Article L1413-14 of the French Public Health Code

Any healthcare professional, healthcare establishment or medico-social establishment or service having observed either a healthcare-associated infection, including a nosocomial infection, or any serious adverse event associated with healthcare, in the context of care provided during investigations, treatments, medical procedures, including cosmetic procedures, or preventive actions, shall report it to the Director General of the Regional Health Agency.

The healthcare professionals concerned analyse the causes of these infections and undesirable events.

The conditions under which compliance with this obligation satisfies other reporting obligations relating to the same facts are specified by regulation.

Tout professionnel de santé, établissement de santé ou établissement et service médico-social ayant constaté soit une infection associée aux soins, dont une infection nosocomiale, soit tout événement indésirable grave associé à des soins, dans le cadre de soins réalisés lors d’investigations, de traitements, d’actes médicaux y compris à visée esthétique ou d’actions de prévention en fait la déclaration au directeur général de l’agence régionale de santé.

Les professionnels de santé concernés analysent les causes de ces infections et événements indésirables.

Les conditions dans lesquelles le respect de cette obligation satisfait d’autres obligations déclaratives portant sur les mêmes faits sont précisées par voie réglementaire.
