Article L142-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

With a view to identifying a foreign national who has not provided proof of the documents mentioned in article L. 812-1 or who has not presented the competent administrative authority with the travel documents required to enforce a decision refusing entry into France, an administrative ban from French territory, an expulsion decision, a deportation order, a decision imposing an obligation to leave French territory, a ban on returning to French territory or a ban from French territory, or who, failing these, has not communicated the information enabling such enforcement, the data from the automated processing of fingerprints implemented by the Ministry of the Interior may be consulted by the expressly authorised agents of the departments of this Ministry under the conditions provided for by Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and by the loi n° 78-17 du 6 janvier 1978 relative à l’informatique, aux fichiers et aux libertés.

En vue de l’identification d’un étranger qui n’a pas justifié des pièces ou documents mentionnés à l’article L. 812-1 ou qui n’a pas présenté à l’autorité administrative compétente les documents de voyage permettant l’exécution d’une décision de refus d’entrée en France, d’une interdiction administrative du territoire français, d’une décision d’expulsion, d’une mesure de reconduite à la frontière, d’une décision portant obligation de quitter le territoire français, d’une interdiction de retour sur le territoire français ou d’une peine d’interdiction du territoire français ou qui, à défaut de ceux-ci, n’a pas communiqué les renseignements permettant cette exécution, les données des traitements automatisés des empreintes digitales mis en œuvre par le ministère de l’intérieur peuvent être consultées par les agents expressément habilités des services de ce ministère dans les conditions prévues par le règlement (UE) 2016/679 du 27 avril 2016 relatif à la protection des personnes physiques à l’égard des traitements des données à caractère personnel et à la libre circulation de ces données et par la loi n° 78-17 du 6 janvier 1978 relative à l’informatique, aux fichiers et aux libertés.
