Article L142-3 of the French Commercial code

The pledge contract is evidenced by a notarial deed or by a private deed.

The preferential right resulting from the pledge contract is enforceable against third parties by the mere fact of registration in a register held at the registry of the competent commercial court, in accordance with procedures determined by decree of the Conseil d’Etat.

Le contrat de nantissement est constaté par un acte authentique ou par un acte sous seing privé.

Le droit de préférence résultant du contrat de nantissement est opposable aux tiers par le seul fait de l’inscription sur un registre tenu au greffe du tribunal de commerce compétent, selon des modalités déterminées par décret en Conseil d’Etat.
