Article L142-5 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The procedures for applying this chapter are laid down, for each of the processing operations mentioned in articles L. 142-1 to L. 142-4, by decree in the Conseil d’Etat, issued after consultation with the Commission nationale de l’informatique et des libertés. These decrees shall specify, in particular, the period for which personal data and recorded information are to be kept and the conditions for updating them, the categories of persons who may access them and the procedures for authorising them to do so, as well as the conditions under which the persons concerned may exercise their rights.

Article L142-5

Les modalités d’application du présent chapitre sont fixées, pour chacun des traitements mentionnés aux articles L. 142-1 à L. 142-4, par décret en Conseil d’Etat, pris après avis de la Commission nationale de l’informatique et des libertés. Ces décrets précisent, notamment, la durée de conservation et les conditions de mise à jour des données à caractère personnel et des informations enregistrées, les catégories de personnes pouvant y accéder et les modalités d’habilitation de celles-ci ainsi que, les conditions dans lesquelles les personnes intéressées peuvent exercer leurs droits.
