Article L142-6 of the French Insurance Code

In the event of insufficient coverage of the commitments covered by the auxiliary allocation accounts referred to in Article L. 142-4, and without prejudice to any proceedings under Title I of Book III, the insurance undertaking and the policyholder(s) shall agree on a recovery plan to re-establish coverage of these commitments by allocating new assets of the insurance undertaking, under conditions agreed between the insurance undertaking and the policyholder(s) of the contracts covered by the auxiliary allocation accounts. In the event of disagreement between the parties, the Autorité de contrôle prudentiel et de résolution determines the amount and the timetable for the allocation of assets by the insurance undertaking.

The preparation of the recovery plan referred to in the first paragraph shall take account of the specific situation of the insurance undertaking in respect of the subsidiary accounts which are the subject of the plan. This plan is made available to members and is sent to the Autorité de contrôle prudentiel et de résolution.

En cas d’insuffisance de couverture des engagements faisant l’objet de la comptabilité auxiliaire d’affectation mentionnée à l’article L. 142-4 et sans préjudice d’éventuelles procédures sur le fondement du titre Ier du livre III, l’entreprise d’assurance et le ou les souscripteurs conviennent d’un plan de redressement permettant de rétablir la couverture de ces engagements par affectation de nouveaux actifs de l’entreprise d’assurance, dans des conditions convenues entre celle-ci et le ou les souscripteurs des contrats faisant l’objet de la comptabilité auxiliaire d’affectation. En cas de désaccord entre les parties, l’Autorité de contrôle prudentiel et de résolution détermine le montant et le calendrier d’affectation d’actifs par l’entreprise d’assurance.

L’élaboration du plan de redressement mentionné au premier alinéa tient compte de la situation particulière de l’entreprise d’assurance au titre de la comptabilité auxiliaire faisant l’objet dudit plan. Ce plan est tenu à la disposition des adhérents et est transmis à l’Autorité de contrôle prudentiel et de résolution.
