Article L1424-99 of the French General Code of Local Authorities

The fire and rescue services in Alsace may decide, by concordant deliberations of their board of directors, to create a public fire and rescue establishment of Alsace.

The provisions of section 5 of this chapter apply to the public fire and rescue establishment of Alsace, subject to the provisions of this article.

The creation of the public fire and rescue establishment of Alsace is subject to the provisions of this article.
The creation of the Alsace public fire and rescue establishment is the subject of an order by the State representative in the administrative district of the State where the establishment is to have its head office. This order is issued after consultation with the representative of the State in the other administrative district of the State concerned and the president of the departmental council of the European Collectivity of Alsace.

The public fire and rescue service of Alsace is the subject of an order by the representative of the State in the administrative district of the State where the establishment is to have its headquarters.
The Alsace public fire and rescue establishment is administered by a board of directors made up of the chairman(s) of the boards of directors of the Bas-Rhin and Haut-Rhin fire and rescue services and representatives, elected from among their members, of each of the boards of directors of the fire and rescue services that make it up.

The chairman of the board of directors of the Bas-Rhin and Haut-Rhin fire and rescue services is elected by the Bas-Rhin and Haut-Rhin fire and rescue services.

The chairman of the Bas-Rhin and Haut-Rhin fire and rescue services is elected by the Bas-Rhin and Haut-Rhin fire and rescue services.
The chairman of the board of directors of the Alsace public fire and rescue service is elected by the board of directors from among the chairmen of the boards of directors of the Bas-Rhin and Haut-Rhin fire and rescue services for the duration of his or her term of office on the board of directors of the fire and rescue service. If the president of the departmental council of the European Collectivity of Alsace is president of the boards of directors of the fire and rescue services of Bas-Rhin and Haut-Rhin, he is automatically appointed president of the public fire and rescue establishment of Alsace.

The representative of the State in the European Collectivity of Alsace is appointed president of the board of directors of the fire and rescue services of Bas-Rhin and Haut-Rhin.
The representative of the State in the administrative district of the State in which the head office of the public establishment is located is automatically present at meetings of the Board of Directors. If a decision appears likely to affect the proper organisation of civil protection, the State representative may ask for a new decision to be taken.

The director of the public fire brigade has the right to attend the meetings of the board of directors.
The director of the public fire and rescue service is appointed by the chairman of the board of directors. The duties of the director may be entrusted, where appropriate, to the departmental director of the fire and rescue services of the administrative district of the State in which the head office of the public establishment is located.

The director of the public fire and rescue establishment is appointed by the chairman of the board of directors.

Les services d’incendie et de secours en Alsace peuvent décider, par délibérations concordantes de leur conseil d’administration, de créer un établissement public d’incendie et de secours d’Alsace.


Les dispositions de la section 5 du présent chapitre s’appliquent à l’établissement public d’incendie et de secours d’Alsace, sous réserve des dispositions du présent article.


La création de l’établissement public d’incendie et de secours d’Alsace fait l’objet d’un arrêté du représentant de l’Etat dans la circonscription administrative de l’Etat où l’établissement doit avoir son siège. Cet arrêté est pris après avis du représentant de l’Etat dans l’autre circonscription administrative de l’Etat intéressée et du président du conseil départemental de la Collectivité européenne d’Alsace.


L’établissement public d’incendie et de secours d’Alsace est administré par un conseil d’administration composé du ou des présidents des conseils d’administration des services d’incendie et de secours du Bas-Rhin et du Haut-Rhin et de représentants, élus en leur sein, de chacun des conseils d’administration des services d’incendie et de secours qui le constituent.


Le président du conseil d’administration de l’établissement public d’incendie et de secours d’Alsace est élu par le conseil d’administration parmi les présidents de conseil d’administration des services d’incendie et de secours du Bas-Rhin et du Haut-Rhin pour la durée de son mandat au conseil d’administration du service d’incendie et de secours. Si le président du conseil départemental de la Collectivité européenne d’Alsace est président des conseils d’administration des services d’incendie et de secours du Bas-Rhin et du Haut-Rhin, il est nommé de plein droit président de l’établissement public d’incendie et de secours d’Alsace.


Le représentant de l’Etat dans la circonscription administrative de l’Etat du siège de l’établissement public assiste de plein droit aux séances du conseil d’administration. Si une délibération paraît de nature à affecter la bonne organisation de la sécurité civile, le représentant de l’Etat peut demander une nouvelle délibération.


Le directeur de l’établissement public d’incendie et de secours est nommé par le président du conseil d’administration. Les fonctions de directeur peuvent être confiées, le cas échéant, au directeur départemental des services d’incendie et de secours de la circonscription administrative de l’Etat du siège de l’établissement public.
