Article L1434-6 of the French Public Health Code

A decree of the Conseil d’Etat shall specify the conditions for the application of this section, in particular :

1° the consultations prior to adoption and the rules for adoption of the regional health project, in particular insofar as they enable it to be coordinated with other public policy planning documents ;

2° The conditions under which specific activities and facilities may be the subject of an inter-regional health plan or a specific regional health plan;

3° The terms and conditions under which health insurance bodies and departments are to participate, by agreement, in the definition and implementation of the regional health plan, as well as the coordination of actions provided for by the agreements on objectives and management referred to inarticle L. 227-1 of the Social Security Code;

4° The conditions under which the directors general of the regional health agencies determine the zones provided for in 1° and 2° of article L. 1434-4 of this code, in particular the procedures for prior consultation.

Article L1434-6

Un décret en Conseil d’Etat précise les conditions d’application de la présente section, notamment :

1° Les consultations préalables à l’adoption et les règles d’adoption du projet régional de santé, notamment en tant qu’elles permettent son articulation avec les autres documents de planification des politiques publiques ;

2° Les conditions dans lesquelles des activités et des équipements particuliers peuvent faire l’objet d’un schéma interrégional de santé ou d’un schéma régional de santé spécifique ;

3° Les modalités selon lesquelles sont prévues, par convention, la participation des organismes et des services d’assurance maladie à la définition et à la mise en œuvre du projet régional de santé ainsi que la coordination des actions prévues par les conventions d’objectifs et de gestion mentionnées à l’article L. 227-1 du code de la sécurité sociale ;

4° Les conditions dans lesquelles les directeurs généraux des agences régionales de santé déterminent les zones prévues aux 1° et 2° de l’article L. 1434-4 du présent code, notamment les modalités de consultation préalable.
