Disciplinary powers are exercised by a National Disciplinary Commission, which is chaired by a president of a chamber of the Cour de cassation, appointed by the first president of the Cour de cassation, and comprises :
1° A member of the Conseil d’Etat, appointed by the Vice-President of the Conseil d’Etat ;
2° One male and one female judge from the courts of appeal, appointed by the first president of the Cour de cassation from a list drawn up by the first presidents of the courts of appeal, each of whom decides on the name of one male and one female judge from his or her court of appeal after consulting the general assembly of judges from the court of appeal;
3° One male and one female employee representative who are or have been employee representatives, appointed by the employee representatives on the Conseil supérieur de la prud’homie from among its members;
4° One male and one female representative of employers who are or have been councillors appointed by the employers’ representatives on the Conseil supérieur de la prud’homie.
An equal number of alternates are appointed under the same conditions.
The members of the National Disciplinary Commission are appointed for four years, under conditions specified by decree in the Conseil d’Etat.
