Article L145-9 of the French Insurance Code

For the application of the fifth paragraph of Article L. 114-1 and the second occurrence of Article L. 114-2, the reference to the insured person is replaced by the reference to the employer or, where applicable, the legal entity, the employee or, where applicable, the member of the legal entity or the beneficiary. For the application of the fourth paragraph of Article L. 112-3 and the last two paragraphs of Article L. 114-1, the reference to the insured is replaced by the reference to the employee or, where applicable, the member of the legal entity. On the first occurrence of Article L. 114-2, the reference to the insured person is replaced by a reference to the employer or, where applicable, the legal entity.

Notwithstanding Article L. 114-1, for the implementation of operations covered by this chapter, the limitation period is extended to five years in respect of incapacity for work.

Pour l’application du cinquième alinéa de l’article L. 114-1 et de la deuxième occurrence à l’article L. 114-2, la référence à l’assuré est remplacée par la référence à l’employeur ou, le cas échéant, à la personne morale, au salarié ou, le cas échéant, au membre de la personne morale ou au bénéficiaire. Pour l’application du quatrième alinéa de l’article L. 112-3 et des deux derniers alinéas de l’article L. 114-1, la référence à l’assuré est remplacée par la référence au salarié ou, le cas échéant, au membre de la personne morale. A la première occurrence à l’article L. 114-2, la référence à l’assuré est remplacée par la référence à l’employeur ou, le cas échéant, à la personne morale.

Par dérogation à l’article L. 114-1, pour la mise en œuvre des opérations relevant du présent chapitre, la prescription est portée à cinq ans en ce qui concerne l’incapacité de travail.
