The time spent by the trade union representative away from the company during working hours in order to carry out his duties is treated as actual working time for the purposes of determining the duration of paid leave and entitlement to social insurance and family benefits, as well as with regard to all the rights that the employee holds by virtue of his seniority in the company.
These absences are remunerated by the employer and do not entail any reduction in the corresponding remuneration and benefits.
Employers are reimbursed by the State for the salaries maintained during the absences of the trade union defender for the performance of his duties, as well as the corresponding benefits and social security charges.
A decree shall determine the terms and conditions of compensation for trade union representatives who carry out their professional activity outside any establishment or who are dependent on several employers.
