Article L1453-8 of the French Labour Code

The trade union representative is bound by professional secrecy in all matters relating to manufacturing processes.

They are bound by an obligation of discretion with regard to information of a confidential nature and given as such by the person they are assisting or representing or by the opposing party in negotiations.

Any breach of these obligations may result in the removal of the person concerned from the list of union representatives by the administrative authority.

Le défenseur syndical est tenu au secret professionnel pour toutes les questions relatives aux procédés de fabrication.

Il est tenu à une obligation de discrétion à l’égard des informations présentant un caractère confidentiel et données comme telles par la personne qu’il assiste ou représente ou par la partie adverse dans le cadre d’une négociation.

Toute méconnaissance de ces obligations peut entraîner la radiation de l’intéressé de la liste des défenseurs syndicaux par l’autorité administrative.
