Article L1457-1 of the French Labour Code

An industrial tribunal member may be challenged :

1° When he has a personal interest in the dispute, the mere fact of being affiliated to a trade union organisation not constituting such a personal interest;

2° If he is the spouse, partner in a civil solidarity pact, cohabitee, parent or relative up to and including the degree of first cousin of one of the parties;

3° If, in the year preceding the challenge, there has been legal, criminal or civil proceedings between him and one of the parties or his spouse, partner in a civil solidarity pact, cohabitee or his parents or relatives in the direct line;

4° If he has given a written opinion in the case;

5° If he is the employer or employee of one of the parties involved.

Le conseiller prud’homme peut être récusé :

1° Lorsqu’il a un intérêt personnel à la contestation, le seul fait d’être affilié à une organisation syndicale ne constituant pas cet intérêt personnel ;

2° Lorsqu’il est conjoint, partenaire lié par un pacte civil de solidarité, concubin, parent ou allié jusqu’au degré de cousin germain inclusivement d’une des parties ;

3° Si, dans l’année qui a précédé la récusation, il y a eu action judiciaire, criminelle ou civile entre lui et une des parties ou son conjoint, partenaire lié par un pacte civil de solidarité, concubin ou ses parents ou alliés en ligne directe ;

4° S’il a donné un avis écrit dans l’affaire ;

5° S’il est employeur ou salarié de l’une des parties en cause.
