Article L1523-6 of the French Public Health Code

Chapter III of Title III of Book III is applicable in the territory of the Wallis and Futuna Islands subject to the following adaptations:

1° In articles L. 1333-8 and L. 1333-30, the reference to Chapter I of Title V of Book IV of Part IV of the Labour Code shall be replaced by the reference to Article 134 of Law No. 52-1322 of 15 December 1952;

2° Article L. 1333-9 shall not apply;

3° The last paragraph of I of Article L. 1333-13 shall read as follows:

“Health professionals involved in the therapeutic management or monitoring of patients exposed to ionising radiation for medical purposes, who are aware of an event likely to be detrimental to the health of individuals linked to this exposure, shall report it as soon as possible to the Nuclear Safety Authority and to the director of the health agency, who shall inform the senior administrator of the territory. ”

4° In Article L. 1333-18, the words “of Article L. 4111-6 of the Labour Code” are replaced by the words “in Article 134 of Law No. 52-1322 of 15 December 1952”;

5° In Article L. 1333-19, the words: “Articles L. 6313-1 to L. 6313-11 of the Labour Code” are replaced by the words: “Article 218 ter of Law no. 52-1322 of 15 December 1952”;

6° In Article L. 1333-20, the words: “or veterinarian” and the words: “, veterinarians” are deleted;

7° In Article L. 1333-24, the words: “and the agents mentioned in Article L. 1435-7 ” are deleted;

8° The third paragraph of II and the first paragraph of III of Article L. 1333-26 do not apply;

9° In Article L. 1333-27, the words: “pursuant to Articles L. 4121-1 et seq. of the Labour Code” are replaced by the words: “with regard to prevention”.

Article L1523-6

Le chapitre III du titre III du livre III est applicable dans le territoire des îles Wallis-et-Futuna sous réserve des adaptations suivantes :

1° Aux articles L. 1333-8 et L. 1333-30, la référence au chapitre Ier du titre V du livre IV de la quatrième partie du code du travail est remplacée par la référence à l’article 134 de la loi n° 52-1322 du 15 décembre 1952 ;

2° L’article L. 1333-9 n’est pas applicable ;

3° Le dernier alinéa du I de l’article L. 1333-13 est ainsi rédigé :

” Les professionnels de santé participant à la prise en charge thérapeutique ou au suivi de patients exposés à des fins médicales à des rayonnements ionisants, ayant connaissance d’un événement susceptible de porter atteinte à la santé des personnes lié à cette exposition, en font la déclaration dans les meilleurs délais à l’Autorité de sûreté nucléaire et au directeur de l’agence de santé qui en informe l’administrateur supérieur du territoire. ” ;

4° A l’article L. 1333-18, les mots : ” de l’article L. 4111-6 du code du travail ” sont remplacés par les mots : ” à l’article 134 de la loi n° 52-1322 du 15 décembre 1952 ” ;

5° A l’article L. 1333-19, les mots : ” des articles L. 6313-1 à L. 6313-11 du code du travail ” sont remplacés par les mots : ” de l’article 218 ter de la loi n° 52-1322 du 15 décembre 1952 ” ;

6° A l’article L. 1333-20, les mots : ” ou vétérinaire ” et les mots : “, des vétérinaires ” sont supprimés ;

7° A l’article L. 1333-24, les mots : ” et les agents mentionnés à l’article L. 1435-7 ” sont supprimés ;

8° Le troisième alinéa du II et le premier alinéa du III de l’article L. 1333-26 ne sont pas applicables ;

9° A l’article L. 1333-27, les mots : ” en application des articles L. 4121-1 et suivants du code du travail ” sont remplacés par les mots : ” en matière de prévention “.
