Article L1541-5 of the French Public Health Code

The following provisions of the preliminary chapters, I and III of Title III of Book I of this Part are applicable in New Caledonia and French Polynesia:

1° Articles L. 1130-1 to L. 1130-6, in the version resulting from law no. 2021-1017 of 2 August 2021, subject to the following adaptations:

a) In article L. 1130-2 and in II of article L. 1130-5, the words: “a consultation with a doctor qualified in genetics for treatment carried out under the conditions laid down in Chapter I of this Title” are replaced by the words: “a consultation likely to ensure appropriate treatment”;

b) In III of Article L. 1130-4, the words: “a consultation with a doctor qualified in genetics” are replaced by the words: “a consultation likely to ensure appropriate treatment”.

2° Article L. 1131-1, in the version resulting from Law no. 2021-1017 of 2 August 2021, subject to the following adaptations:

a) In I, the words: “approved pursuant to Article L. 1114-1” are deleted;

b) In II, the words: “a consultation with a doctor qualified in genetics” are replaced by the words: “a consultation to ensure appropriate care”;

c) In V, the words: “qualified in genetics” are deleted.

2° bis Article L. 1131-1-1, as amended by Law no. 2021-1017 of 2 August 2021, subject to the following adaptations:

a) In I and II, the words: “head of the procreation medical assistance centre” are replaced by the words: “procreation medical assistance doctor”;

b) In III, the words: “head of a procreation medical assistance centre” are replaced by the words: “procreation medical assistance doctor”.

3° Article L. 1131-1-2, as amended by Law no. 2021-1017 of 2 August 2021, subject to the replacement in the third paragraph of the words: “consultation with a doctor qualified in genetics” by the words: “consultation to ensure appropriate care”.

4° Article L. 1131-1-3 is applicable in the version resulting from Law no. 2021-1017 of 2 August 2021, with the exception of the words in II: “By way of derogation from Article L. 6211-11 and II of Article L. 6211-19” and the words: “authorised in application of Article L. 1131-2-1”;

5° Article L. 1131-3, in the version resulting from Law no. 2021-1017 of 2 August 2021, with the exception of the words: “Subject to the provisions of the third paragraph of Article L. 1131-2-1,”;

6° Articles L. 1131-4 and L. 1131-5 ;

7° Article L. 1131-6, in the version resulting from Law no. 2021-1017 of 2 August 2021, with the exception of its last paragraph;

8° Article L. 1131-7 ;

9° Articles L. 1133-1 to L. 1133-3 ;

10° Article L. 1133-4, with the exception of the words: “and the authorisation provided for in Article L. 1131-2-1 of the same Code”;

11° Articles L. 1133-4-1 and L. 1133-5.

Article L1541-5

Les dispositions suivantes des chapitres préliminaire, Ier et III du titre III du livre Ier de la présente partie sont applicables en Nouvelle-Calédonie et en Polynésie française :

1° Les articles L. 1130-1 à L. 1130-6, dans leur rédaction résultant de la loi n° 2021-1017 du 2 août 2021, sous réserve des adaptations suivantes :

a) A l’article L. 1130-2 et au II de l’article L. 1130-5, les mots : “ une consultation chez un médecin qualifié en génétique pour une prise en charge réalisée dans les conditions fixées au chapitre Ier du présent titre ” sont remplacés par les mots : “ une consultation de nature à assurer une prise en charge adaptée ” ;

b) Au III de l’article L. 1130-4, les mots : “ une consultation chez un médecin qualifié en génétique ” sont remplacés par les mots : “ une consultation de nature à assurer une prise en charge adaptée ”

2° L’article L. 1131-1, dans sa rédaction résultant de la loi n° 2021-1017 du 2 août 2021, sous réserve des adaptations suivantes :

a) Au I, les mots : “ agréées en application de l’article L. 1114-1 ” sont supprimés ;

b) Au II, les mots : “ une consultation chez un médecin qualifié en génétique ” sont remplacés par les mots : “ une consultation de nature à assurer une prise en charge adaptée ” ;

c) Au V, les mots : “ qualifié en génétique ” sont supprimés.

2° bis L’article L. 1131-1-1, dans sa rédaction résultant de la loi n° 2021-1017 du 2 août 2021, sous réserve des adaptations suivantes :

a) Au I et au II, les mots : “ responsable du centre d’assistance médicale à la procréation ” sont remplacés par les mots : “ médecin d’assistance médicale à la procréation ” ;

b) Au III, les mots : “ responsable d’un centre d’assistance médicale à la procréation ” sont remplacés par les mots : “ médecin d’assistance médicale à la procréation ”

3° L’article L. 1131-1-2, dans sa rédaction résultant de la loi n° 2021-1017 du 2 août 2021, sous réserve du remplacement au troisième alinéa des mots : “ consultation chez un médecin qualifié en génétique ” par les mots : “ consultation de nature à assurer une prise en charge adaptée ”

4° L’article L. 1131-1-3 est applicable dans sa rédaction résultant de la loi n° 2021-1017 du 2 août 2021, à l’exception au II des mots : “ Par dérogation à l’article L. 6211-11 et au II de l’article L. 6211-19 ” et des mots : “ autorisé en application de l’article L. 1131-2-1 ” ;

5° L’article L. 1131-3, dans sa rédaction résultant de la loi n° 2021-1017 du 2 août 2021, à l’exception des mots : “ Sous réserve des dispositions du troisième alinéa de l’article L. 1131-2-1, ” ;

6° Les articles L. 1131-4 et L. 1131-5 ;

7° L’article L. 1131-6, dans sa rédaction résultant de la loi n° 2021-1017 du 2 août 2021, à l’exception de son dernier alinéa ;

8° L’article L. 1131-7 ;

9° Les articles L. 1133-1 à L. 1133-3 ;

10° L’article L. 1133-4, à l’exception des mots : ” et de l’autorisation prévue à l’article L. 1131-2-1 du même code ” ;

11° Les articles L. 1133-4-1 et L. 1133-5.
