Article L1542-4 of the French Public Health Code

The Etablissement français du sang instituted in Chapter II of Title II of Book II of this Part may enter into technical cooperation agreements with the authorities of New Caledonia or French Polynesia. In particular, an agreement may specify the terms and conditions under which the insurance taken out by the Etablissement Français du Sang against the risks incurred by donors as a result of collection operations covers the liability, as a result of these same risks, of the blood transfusion establishments of New Caledonia and French Polynesia.

L’Etablissement français du sang institué au chapitre II du titre II du livre II de la présente partie peut passer des conventions de coopération technique avec les autorités de la Nouvelle-Calédonie ou de la Polynésie française. Une convention peut notamment préciser selon quelles modalités l’assurance contractée par l’Etablissement français du sang du fait des risques encourus par les donneurs en raison des opérations de prélèvement couvre la responsabilité, du fait de ces mêmes risques, des établissements de transfusion sanguine de Nouvelle-Calédonie et de Polynésie française.
