Article L1614-8 of the French General Code of Local Authorities

Financial compensation for the investment costs of ports transferred pursuant to the first paragraph of Article 6 of Law no. 83-663 of 22 July 1983 supplementing Law no. 83-8 of 7 January 1983 relating to the division of powers between communes, départements, regions and the State is included in the general decentralisation allowance of the départements concerned.

The total amount of compensation received by the departments concerned corresponds to the updated amount of the special State contribution created in application of article 95 of law no. 83-8 du 7 janvier 1983 précitée, constaté au 1er janvier 2007.

The respective share due to each department is obtained by applying a coefficient to the total amount of compensation referred to in the second paragraph. This coefficient is calculated for each department by comparing the updated average of the appropriations paid to it from 1996 to 2005 with the updated average of the appropriations paid to all the departments concerned under the special assistance scheme over these ten years.

Financial compensation for the investment costs of ports transferred pursuant to Article 30 of Law no. 2004-809 of 13 August 2004 on local freedoms and responsibilities is included in the general decentralisation allowance of the local authorities concerned and calculated in accordance with I of the article 119 of the same law.

From 1 January 2016, when a region is formed by grouping together several regions, in accordance with Article 1 of Law No. 2015-29 of 16 January 2015 on the delimitation of regions, regional and departmental elections and amending the electoral calendar, the amount of the general decentralisation grant paid to it pursuant to this article corresponds to the sum of the amounts paid to the regions to which it succeeds under the conditions applicable prior to the grouping.

A Conseil d’Etat decree shall determine the terms and conditions for the application of this article.

La compensation financière des charges d’investissement des ports transférés en application du premier alinéa de l’article 6 de la loi n° 83-663 du 22 juillet 1983 complétant la loi n° 83-8 du 7 janvier 1983 relative à la répartition des compétences entre les communes, les départements, les régions et l’Etat est intégrée dans la dotation générale de décentralisation des départements concernés.

Le montant total de la compensation dont bénéficient les départements concernés correspond au montant actualisé du concours particulier de l’Etat créé en application de l’article 95 de la loi n° 83-8 du 7 janvier 1983 précitée, constaté au 1er janvier 2007.

La part respective revenant à chaque département est obtenue en appliquant un coefficient au montant total de la compensation visé au deuxième alinéa. Ce coefficient est calculé pour chaque département en rapportant la moyenne actualisée des crédits qui lui ont été versés de 1996 à 2005 à la moyenne actualisée des crédits versés à l’ensemble des départements concernés au titre du concours particulier au cours de ces dix années.

La compensation financière des charges d’investissement des ports transférés en application de l’article 30 de la loi n° 2004-809 du 13 août 2004 relative aux libertés et responsabilités locales est intégrée dans la dotation générale de décentralisation des collectivités concernées et calculée conformément au I de l’article 119 de la même loi.

A compter du 1er janvier 2016, lorsqu’une région est constituée par regroupement de plusieurs régions, conformément à l’article 1er de la loi n° 2015-29 du 16 janvier 2015 relative à la délimitation des régions, aux élections régionales et départementales et modifiant le calendrier électoral, le montant de la dotation générale de décentralisation qui lui est versé en application du présent article correspond à la somme des montants versés aux régions auxquelles elle succède dans les conditions applicables avant le regroupement.

Un décret en Conseil d’Etat détermine les modalités d’application du présent article.
