Article L172-27 of the French Insurance Code

Surrender may be neither partial nor conditional.

It transfers the rights of the insured on the insured objects to the insurer, subject to payment by the insured of the full insured sum, and the effects of this transfer go back between the parties to the moment when the insured notifies the insurer of his wish to surrender.

The insurer may, without prejudice to payment of the sum insured, refuse the transfer of ownership.

Le délaissement ne peut être ni partiel, ni conditionnel.

Il transfère les droits de l’assuré sur les objets assurés à l’assureur, à charge par lui de payer la totalité de la somme assurée et les effets de ce transfert remontent entre les parties au moment où l’assuré notifie à l’assureur sa volonté de délaisser.

L’assureur peut, sans préjudice du paiement de la somme assurée, refuser le transfert de propriété.
