Article L173-22-1 of the French Insurance Code

Suspension and cancellation for non-payment of a premium in respect of property insurance contracts covering damage to goods carried shall have no effect in respect of bona fide third parties who are beneficiaries of the insurance by virtue of a transfer made prior to notification of the suspension or cancellation.

In the event of a claim, the insurer may, by means of an express clause contained in the documentary endorsement, set off against these beneficiaries, in the same amount, the premium relating to the insurance which they claim to benefit from.

La suspension et la résiliation pour défaut de paiement d’une prime relative à des contrats d’assurance de biens couvrant les dommages subis par les marchandises transportées sont sans effet à l’égard des tiers de bonne foi, bénéficiaires de l’assurance en vertu d’un transfert antérieur à la notification de la suspension ou de la résiliation.


En cas de sinistre, l’assureur peut, par une clause expresse figurant à l’avenant documentaire, opposer à ces bénéficiaires, à due concurrence, la compensation de la prime afférente à l’assurance dont ils revendiquent le bénéfice.
