Article L175-18 of the French Insurance Code

The insured must declare any claim of which he/she is aware within the time limits stipulated in the insurance contract.

The insurer may provide for a total or partial forfeiture clause if the insured has made an inaccurate claim declaration in bad faith, or if the insured is late in declaring the claim. In the latter case, the insurer must prove that the delay caused it prejudice.

L’assuré doit déclarer dans les délais prévus au contrat d’assurance tout sinistre dont il a connaissance.


L’assureur peut prévoir une clause de déchéance totale ou partielle lorsque l’assuré a fait de mauvaise foi une déclaration inexacte relative au sinistre ou lorsque l’assuré a déclaré tardivement le sinistre. Dans cette dernière hypothèse, l’assureur doit prouver que ce retard lui a causé un préjudice.
