Article L211-30 of the French Monetary and Financial Code

If the transferor defaults on its obligation to pay the transfer price, the securities remain the property of the transferee. If the transferee defaults on its obligation to transfer the securities, the transfer price remains the property of the transferor.

Au terme fixé pour la rétrocession, le cédant paye le prix convenu au cessionnaire et ce dernier rétrocède les titres financiers au cédant ; si le cédant manque à son obligation de payer le prix de la rétrocession, les titres restent acquis au cessionnaire et si le cessionnaire manque à son obligation de rétrocéder les titres, le montant de la cession reste acquis au cédant.
