The maire délégué is elected by the municipal council of the new commune from among its members, under the conditions set out in Article L. 2122-7.
By way of derogation, the mayor of the former commune in office at the time of the creation of the new commune automatically becomes deputy mayor until the next renewal of the municipal council. The same applies in the cases provided for in the second and third paragraphs of article L. 2113-10, for the mayor of the former commune chef-lieu, for the mayors of the associated communes and for the mayors of the delegated communes in office at the time of the creation of the new commune.
The offices of mayor of the new commune and of mayor delegate are compatible. Their allowances cannot be combined.
