Article L2113-8 of the French Public procurement code

A grouping of orders may be formed with purchasers from other Member States of the European Union, provided that this choice has not been made with the aim of evading the application of national provisions affecting public policy.
Notwithstanding the provisions of the second paragraph of article L. 2113-7, and subject to the stipulations of international agreements and administrative arrangements between the Member States to which they belong, the members of the grouping agree on the division of responsibilities and on the law applicable to the contract, chosen from among the laws of these States.

Un groupement de commandes peut être constitué avec des acheteurs d’autres Etats membres de l’Union européenne, à condition que ce choix n’ait pas été fait dans le but de se soustraire à l’application de dispositions nationales qui intéressent l’ordre public.
Nonobstant les dispositions du second alinéa de l’article L. 2113-7, et sous réserve des stipulations d’accords internationaux et d’arrangements administratifs, entre les Etats membres dont ils relèvent, les membres du groupement s’accordent sur la répartition des responsabilités ainsi que sur le droit applicable au marché, choisi parmi les droits de ces Etats.
