Article L2113-9 of the French Public procurement code

Where purchasers have joined a common transnational entity, constituted in particular in the form of a European grouping for territorial cooperation, the statutes or a decision of the competent body of this entity shall determine the rules applicable to the contracts of this entity, which shall be:
1° Either the law of the State in which its registered office is located;
2° Or the law of the State in which it carries out its activities.
The choice of the applicable law may not be intended to avoid the application of national provisions of public policy.

Lorsque des acheteurs ont adhéré à une entité commune transnationale, constituée notamment sous la forme d’un groupement européen de coopération territoriale, les statuts ou une décision de l’organe compétent de cette entité déterminent les règles applicables aux marchés de cette entité, lesquelles sont :
1° Soit la loi de l’Etat dans lequel se trouve son siège ;
2° Soit la loi de l’Etat dans lequel elle exerce ses activités.
Le choix de la loi applicable ne peut avoir pour but de se soustraire à l’application de dispositions nationales qui intéressent l’ordre public.
