Article L212-10-1 of the French Cinema and Moving Image Code

I.-The Commission départementale d’aménagement cinématographique authorises projects by an absolute majority of the members present. The minutes shall indicate the vote cast by each member.

The State representative in the département does not take part in the vote.

II – The Commission départementale d’aménagement cinématographique (Departmental Cinematographic Development Commission) makes its decision within two months of the referral.

After this period, the decision is deemed to be favourable.

The members of the Commission départementale d’aménagement cinématographique are informed of the applications for authorisation submitted at least ten days before the decision is taken.

The mayor and the applicant are notified of the decision within ten days. The film ombudsman is also notified.

Article L212-10-1

I.-La commission départementale d’aménagement cinématographique autorise les projets par un vote à la majorité absolue des membres présents. Le procès-verbal indique le sens du vote émis par chacun de ces membres.

Le représentant de l’Etat dans le département ne prend pas part au vote.

II.-La commission départementale d’aménagement cinématographique se prononce dans un délai de deux mois à compter de sa saisine.

Passé ce délai, la décision est réputée favorable.

Les membres de la commission départementale d’aménagement cinématographique ont connaissance des demandes d’autorisation déposées au moins dix jours avant d’avoir à statuer.

La décision est notifiée dans les dix jours au maire et au pétitionnaire. Elle est également notifiée au médiateur du cinéma.
