Article L212-26 of the French Cinema and Moving Image Code

A decree in the Conseil d’Etat, issued after obtaining the opinion of the Autorité de la concurrence, sets out the terms and conditions for the application of this section. It shall specify in particular:

1° The procedures for issuing and withdrawing approval for programming groups or agreements ;

2° The other obligations of the programming contract concluded between a group and its member undertakings or between the member undertakings of a cartel;

3° The procedures for signing, notifying, approving and monitoring programming commitments.

Un décret en Conseil d’Etat, pris après avis de l’Autorité de la concurrence, fixe les modalités d’application de la présente section. Il précise notamment :

1° Les modalités de délivrance et de retrait de l’agrément des groupements ou ententes de programmation ;

2° Les autres obligations du contrat de programmation conclu entre un groupement et les entreprises qui en sont membres ou entre les entreprises membres d’une entente ;

3° Les modalités de souscription, de notification, d’homologation et de contrôle des engagements de programmation.
