Article L212-3 of the French Cinema and Moving Image Code

When the activity of cinema entertainment venue operator is carried out by a natural person, the authorisation is issued to this person on presentation of proof of registration in the Trade and Companies Register.

When the activity of cinema entertainment venue operator is carried out by a legal entity, the authorisation is issued to the natural person who is the legal or statutory representative of this entity, subject to the following provisions:

1° For associations and public establishments, the authorisation is granted to the manager designated by the deliberative body provided for in the articles of association;

2° In the case of public authorities operating on a self-governing basis, authorisation is granted to the natural person designated by the competent authority.

The authorisation is personal and non-transferable. It may not be granted to persons who have been the subject of a court order prohibiting them from carrying on a commercial activity.

Article L212-3

Lorsque l’activité d’exploitant d’établissement de spectacles cinématographiques est exercée par une personne physique, l’autorisation est délivrée à cette personne sur justification de son immatriculation au registre du commerce et des sociétés.

Lorsque l’activité d’exploitant d’établissement de spectacles cinématographiques est exercée par une personne morale, l’autorisation est délivrée à la personne physique représentant légal ou statutaire de celle-ci sous réserve des dispositions suivantes :

1° Pour les associations et pour les établissements publics, l’autorisation est accordée au dirigeant désigné par l’organe délibérant prévu par les statuts ;

2° Pour les collectivités publiques intervenant en régie, l’autorisation est accordée à la personne physique désignée par l’autorité compétente.

L’autorisation est personnelle et incessible. Elle ne peut être accordée aux personnes ayant fait l’objet d’une décision judiciaire leur interdisant l’exercice d’une activité commerciale.
