Article L2121-14 of the French General Code of Local Authorities

The town council is chaired by the mayor or, in his absence, by the person who replaces him.

In meetings where the mayor’s administrative account is debated, the town council elects its chairman.

In this case, the mayor may, even if he is no longer in office, attend the discussion; but he must withdraw when the vote is taken.

Le conseil municipal est présidé par le maire et, à défaut, par celui qui le remplace.

Dans les séances où le compte administratif du maire est débattu, le conseil municipal élit son président.

Dans ce cas, le maire peut, même s’il n’est plus en fonction, assister à la discussion ; mais il doit se retirer au moment du vote.
