The resignation of the mayor or a deputy mayor is sent to the representative of the State in the department. It is definitive as from its acceptance by the representative of the State in the department or, in the absence of such acceptance, one month after a new dispatch of the resignation recorded by registered letter.
The mayor and deputy mayors continue in office until their successors are installed, subject to the provisions of articles L. 2121-36, L. 2122-5, L. 2122-6, L. 2122-16 and L. 2122-17.
However, in the event of a full renewal, the duties of mayor and deputy mayor are, from the installation of the new council until the election of the mayor, performed by the municipal councillors in the order of the table.
The procedure provided for in this article also applies when the mayor or deputy mayor simultaneously resigns from the office of municipal councillor.
As an exception to the provisions of the first paragraph, resignations of mayors and deputy mayors given pursuant to articles L. 46-1, L. O. 151 and L. O. 151-1 of the Electoral Code are final from the date of their receipt by the representative of the State in the department.
