The mayor is solely responsible for administration, but may, under his supervision and responsibility, delegate part of his duties by decree to one or more of his deputies and to members of the municipal council.
A member of the municipal council who has resigned from the office of mayor pursuant to articles LO 141 of the Electoral Code, L. 3122-3 ou L. 4133-3 of this code may not receive a delegation until the end of his term of office as a municipal councillor or until the end of the term of office or the office that placed him in a situation of incompatibility.
Members of the municipal council holding a mandate as a deputy, senator or representative in the European Parliament may not receive or retain a delegation, unless it relates to the attributions exercised on behalf of the State mentioned in sub-section 3 of this section.
When the mayor has withdrawn the delegations he had given to a deputy, the municipal council must decide on the latter’s continuation in office.
