Article L2123-28 of the French General Code of Local Authorities

Elected representatives who receive an official allowance pursuant to the provisions of this code or any other provision governing compensation for their duties are affiliated to the supplementary pension scheme instituted for the benefit of non-tenured public authority employees.

Pensions paid pursuant to this article may be combined without limitation with any other pension or retirement benefits.

A decree sets the conditions under which the services rendered by mayors and deputy mayors are taken into account.

Article L2123-28

Les élus qui perçoivent une indemnité de fonction en application des dispositions du présent code ou de toute autre disposition régissant l’indemnisation de leurs fonctions sont affiliés au régime complémentaire de retraite institué au profit des agents non titulaires des collectivités publiques.

Les pensions versées en exécution du présent article sont cumulables sans limitation avec toutes autres pensions ou retraites.

Un décret fixe les conditions dans lesquelles sont pris en compte les services rendus par les maires et adjoints.
